Fees, Payments & Refund Policy
At Qadir Chambers, we are committed to maintaining the highest standards of professional integrity, transparency, and client service. As a legal practice, we recognize the importance of ensuring that clients clearly understand the financial terms governing our professional engagement.
This Fees, Payments & Refund Policy outlines the principles applicable to consultations, legal representation, advisory services, litigation support, intellectual property matters, corporate legal services, documentation, and all other professional services provided by Qadir Chambers.
By engaging our services, scheduling a consultation, retaining our firm, or making any payment to Qadir Chambers, you acknowledge that you have read, understood, and agreed to the terms set forth in this Policy.
2. Scope of Application
This Policy applies to all services offered by Qadir Chambers, including but not limited to:
- Legal consultations and case evaluations
- Civil and criminal litigation services
- Family law matters
- Corporate and commercial legal advisory
- Intellectual property services
- Trademark registration and prosecution
- Copyright registration matters
- Patent-related legal assistance
- Contract drafting, review, and negotiation
- Legal notices and opinions
- Arbitration and dispute resolution services
- Regulatory and compliance advisory
- Retainer-based legal services
- Any ancillary legal or professional services provided by the Firm
This Policy should be read together with any Engagement Letter, Service Agreement, Retainer Agreement, or other written arrangements entered into between the Firm and the Client.
3. Nature of Legal Services
Legal services are professional services that involve the application of legal expertise, knowledge, strategic analysis, professional judgment, research, and representation.
Unlike physical products, legal services cannot be returned once they have been performed. A substantial portion of legal work occurs through intellectual effort, case preparation, legal analysis, drafting, consultations, strategic planning, correspondence, negotiations, and representation before courts, tribunals, regulatory bodies, or governmental authorities.
Accordingly, fees charged by Qadir Chambers compensate the Firm for professional services rendered and resources expended, rather than any guaranteed legal outcome.
4. Consultation Fees
The Firm may offer consultations either on a complimentary basis or for a specified professional fee, depending upon the nature and complexity of the matter.
Consultation services may include:
- Preliminary case assessments
- Legal guidance and recommendations
- Review of documentation
- Strategic legal advice
- Assessment of potential legal remedies
- Discussion of available legal options
Where a consultation fee is applicable, the amount shall be communicated to the client before the consultation is scheduled.
Once a consultation has taken place, the corresponding fee shall be deemed earned in full and shall generally be non-refundable.
5. Professional Fees and Billing Structure
Professional fees may be charged on one or more of the following bases:
Fixed Fee Arrangements
For certain services, the Firm may charge a fixed professional fee agreed upon in advance.
Hourly Billing
Some matters may be billed according to the time spent by lawyers, associates, consultants, or support staff working on the matter.
Retainer-Based Engagements
Clients may be required to maintain an advance retainer from which professional fees and expenses are periodically deducted.
Stage-Based Billing
For litigation and regulatory matters, fees may be structured according to different procedural stages of the matter.
The billing structure applicable to a particular engagement shall be communicated to the client at the commencement of representation.
6. Advance Payments and Retainers
The Firm may require advance payment or a retainer before commencing work.
Retainers serve multiple purposes, including:
- Reserving legal resources
- Facilitating case preparation
- Covering anticipated professional services
- Ensuring continuity of representation
- Meeting administrative and operational requirements
Unless expressly agreed otherwise in writing, the Firm reserves the right to suspend or decline services where required retainers or advance payments have not been received.
Where applicable, retainers may be applied toward:
- Professional fees
- Administrative costs
- Filing expenses
- Research costs
- Documentation expenses
- Court-related expenditures
7. Client Responsibility for Costs and Disbursements
In addition to professional fees, clients may be responsible for certain third-party costs and disbursements, including but not limited to:
- Court fees
- Government filing fees
- Registry charges
- Stamp duties
- Notarization costs
- Courier and delivery expenses
- Expert witness fees
- Translation expenses
- Investigation costs
- Intellectual property filing charges
Such expenses may be payable in advance and are generally separate from the Firm’s professional fees.
8. Refund Policy
Because legal services involve substantial professional effort and time commitments, refunds are limited and evaluated on a case-by-case basis.
Refund requests may be considered only where consistent with the terms of the applicable engagement and where legal work has not substantially commenced.
Any refund determination shall be made at the sole discretion of Qadir Chambers after reviewing the circumstances of the matter.
9. Circumstances in Which Refunds May Be Considered
Subject to review and verification, refunds may be considered in the following circumstances:
Duplicate Payment
Where a client inadvertently makes duplicate payments for the same service, the excess amount may be refunded after confirmation.
Payment Processing Error
Where a payment has been processed in error, the Firm may authorize a corrective refund.
Services Not Yet Commenced
Where the client requests cancellation before any meaningful work has begun, a partial refund may be considered after deducting administrative and processing costs.
Firm-Initiated Non-Engagement
Where the Firm declines representation before commencing substantive work, any unearned fees may be refunded.
10. Non-Refundable Fees
The following fees shall ordinarily be considered non-refundable once incurred:
- Consultation fees
- Case evaluation fees
- Legal opinion fees
- Drafting fees
- Research fees
- Court appearance fees
- Hearing fees
- Documentation preparation fees
- Filing charges
- Administrative processing fees
- Intellectual property filing services
- Regulatory compliance services
Once professional services have been rendered, corresponding fees shall generally be deemed earned.
11. Intellectual Property Services
For trademark, copyright, patent, and related intellectual property matters, clients acknowledge that approvals and registrations are ultimately subject to the determination of relevant governmental authorities.
Accordingly:
- Filing fees are non-refundable.
- Government charges are non-refundable.
- Third-party expenses are non-refundable.
- Rejection of an application does not create a right to a refund.
- Delays caused by governmental agencies do not create refund entitlement.
The Firm’s obligation is to provide professional legal assistance and representation; it cannot guarantee registration or approval.
12. No Guarantee of Legal Outcome
Qadir Chambers provides professional legal representation based upon legal knowledge, experience, and diligent effort.
However, no lawyer, law firm, or legal professional can lawfully guarantee:
- Success in litigation
- Favorable judgments
- Regulatory approvals
- Registration outcomes
- Settlement results
- Commercial outcomes
Legal matters depend upon numerous factors beyond the Firm’s control, including judicial discretion, evidence, legal developments, governmental decisions, and actions of opposing parties.
Therefore, dissatisfaction with the outcome of a legal matter shall not constitute grounds for a refund.
13. Cancellation of Services
Clients seeking to terminate or cancel services should notify the Firm in writing.
Upon receipt of such notice, the Firm will evaluate:
- Work completed to date
- Resources allocated
- Expenses incurred
- Outstanding obligations
Any refund, if applicable, shall be calculated after accounting for earned fees and incurred costs.
14. Suspension of Services for Non-Payment
The Firm reserves the right to suspend, postpone, or terminate legal services where a client fails to satisfy payment obligations.
Such suspension shall not relieve the client of responsibility for fees already incurred.
The Firm shall not be liable for any consequences resulting from delays caused by non-payment.
15. Processing of Approved Refunds
Where a refund is approved:
- Verification procedures may apply.
- Supporting documentation may be required.
- Refunds shall be processed within a reasonable timeframe.
- Approved refunds may be returned through the original payment method where practicable.
The Firm reserves the right to deduct applicable administrative, banking, processing, or transaction charges.
16. Amendments to This Policy
Qadir Chambers reserves the right to amend, revise, or update this Policy at any time without prior notice.
Updated versions shall become effective upon publication on the Firm’s website.
Clients are encouraged to review this Policy periodically to remain informed of any changes.
